General terms and conditions of sale 2021

  1. ADMISSION

The proposed activities are open to people: who have no medical conditions affecting the practice of the activities selected. For nautical activities: knowing how to swim is a necessity. For cycling: knowing how to cycle is a necessity. Age limits apply for certain services. You must have personal civil liability insurance in order to undertake the activities reserved. Use of the tepees is for a maximum of 7 people and for a single night. Use is strictly subject to the purchase of at least one activity per person. Any damage will be invoiced in accordance with the current rates displayed at reception. Tepees are available between 4 pm and 6 pm, and must be vacated after an “inventory” between 8:30 am and 10 am the next morning. A bank deposit of €800 will be required. Bike rental is strictly subject to a bank deposit, depending on the type of bike (displayed on site).

  1. EXCLUSION

NaturEvasion reserves the right to exclude anyone: who does not comply with the activity-specific safety instructions; who lacks the required skills; who is not in a condition to carry out the activities (under the influence of alcohol and/or narcotic products); who is not wearing sportswear suitable for sporting activities (shorts or trousers, T-shirt, closed-toe shoes for entering the water); scarves or similar items and jewellery are not permitted; who is late for the appointed time for the reserved activity; who does not have the bank guarantees required when necessary (for the rental of bicycles and/or tepees).

  1. REGISTRATION, RESERVATION, PURCHASE, AND RENTAL

Registration for NaturEvasion activities takes place via the booking platform, and is definitive following: Approval of the general terms and conditions of sale. By clicking the button “I have read the general terms and conditions of sale and I agree to comply with them without reservation” on the website www.naturevasion.com , the user confirms their approval, and confirms acceptance of the said general terms and conditions of sale. Payment for the reserved activity or activities. Failure to comply with these conditions may result in the cancellation of the reservation. Registration implies that the customer has read these general terms and conditions of sale and agrees to comply with them without reservation.

  1. CHANGES TO THE PROGRAMME SELECTED, OR THE NUMBER OF PARTICIPANTS

Any change, (e.g. in the number of participants, activities or programmes selected, schedules, or dates, etc.), must be sent by email to contact@naturevasion.com at the latest, 48 hours prior to the scheduled start of the activity. Such changes are subject to acceptance by NaturEvasion. If less than 48 hours’ notice is given, payment for the services reserved will remain due to NaturEvasion.

  1. REFUNDS

No refunds will be made in the event of late arrivals, early departures or activities not undertaken.

  1. CANCELLATION

By the customer Individual and group cancellations must be sent by email to contact@naturevasion.com as soon as possible, and at least 72 hours before the scheduled activity date. Amounts paid will be retained by NaturEvasion in accordance with the following terms: From 6 to 3 days before the scheduled date of the activity: up to 30% of the invoice amount. Less than 48 hours before the scheduled date and time of commencement of the activity: 70% of the invoice amount. By the organiser: sums will be refunded fully without charge.  

  1. PENALTIES FOR EXCEEDING STATED ACTIVITY TIMES

Arrival time is 5:30 pm at the latest. If this deadline is not met, an additional charge shall be applied: from 5:30 pm to 6:30 pm: €40/person, beyond 6:30 pm: €90/person. People arriving after 7 pm must return on their own, no additional shuttle buses will be provided.  

  1. PROFESSIONAL CIVIL LIABILITY INSURANCE

NaturEvasion has Professional Civil Liability Insurance: GENERALI No AM471201 The loss or theft of personal effects (such as glasses, electronic devices or any other personal objects) shall remain the sole responsibility of the owner, who shall have no recourse against NaturEvasion. The sealing of watertight containers is not guaranteed, since it relies on correct use by the participant.  

  1. EXCEPTIONAL CIRCUMSTANCES

NaturEvasion reserves the right to cancel or postpone activity dates for safety reasons, such as extremely bad weather forecasts or dangerous water levels. In the event of cancellation, amounts paid will be refunded.  

  1. BROKEN, LOST, OR STOLEN EQUIPMENT AND DEPOSITS

For all activities, any lost, damaged, or stolen equipment will be invoiced to the customer and must be paid for on the same day, in accordance with the rates displayed at reception. Bicycle and GPS rentals, as well as tepee rentals, are subject to the payment of deposits as per the examples and rates displayed at reception.  

  1. DELIVERY OF EQUIPMENT (bicycles, canoes, etc.)

The price for deliveries of bicycles or canoes is subject to a rate depending on the quantity delivered and the number of round-trip kilometres. You may find out about the prices charged at reception.  

  1. GENERAL TERMS AND CONDITIONS OF SALE SPECIFIC TO BIKE RENTALS

 

  • ARTICLE 12/A: CONTRACTUAL RELATIONS

NATUREVASION (hereinafter “the Lessor”) rents the equipment to the party entering into the contract (hereinafter “the User”), as described in the rental contract (hereinafter “the Contract”). This rental shall be governed by these general terms and conditions of sale and rental, acceptance of which the User acknowledges, having read them prior to signature of the Contract. By clicking the button “I have read the general terms and conditions of rental and I agree to comply with them without reservation” on the website www.naturevasion.com, the User confirms their approval, and confirms acceptance of the said general terms and conditions.

  • ARTICLE 12/B: CONDITIONS PRECEDENT TO RENTAL, RELATING TO THE USER

The User must be a natural person over the age of 18. Children and young people under the age of 16 must be accompanied by an adult acting in the capacity of User. Failing this, prior written consent from a legal representative who assumes the capacity of User is mandatory. When signing the Contract, the User will be asked for a valid identity document, of which a copy will be made.

  • ARTICLE 12/C: PURPOSE OF THE CONTRACT

Rental of a bicycle with or without electric assistance, with or without accessories, furnished with equipment provided by the Lessor and described in Article 4 of these terms and conditions of rental, and in the Contract.

  • ARTICLE 12/D: EQUIPPING OF RENTAL EQUIPMENT

Each bicycle which is rented, with or without electric assistance, is equipped in accordance with current standards. Rental equipment bears the Lessor’s signage. In addition to these items, the Lessor shall make a helmet, anti-puncture spray, and an anti-theft device available to the User for the duration of the rental. The Lessor shall also provide a backpack and a bag or basket free of charge.

  • ARTICLE 12/E: RENTAL AND SERVICE RATES

Rental and service rates applicable are those published on the website and appearing in the Contract. The rental amount is payable upon collection of the rental equipment by bank card, cash, “chèques vacances” (holiday vouchers), or by bank transfer of the full amount, to be credited to the Lessor’s account by the time of collection at the latest. Cheques are not accepted.

  • ARTICLE 12/F: DEPOSIT

Upon the rental equipment being made available to the User, the User will present an identity document, of which a copy will be made, and a deposit, the value of which appears in the Contract. This security deposit shall take the form of a bank pre-authorisation. When the User returns the rental equipment, the deposit will be returned, less any damage provided for in Article 11 below. The deposit does not constitute a limit of guarantee, and the Lessor shall retain, if necessary, the right to pursue the User for the purpose of obtaining full compensation for loss or damage. The User expressly authorises the Lessor to debit any unpaid amount relating to the User’s rental from the User’s method of payment. The User agrees to be photographed upon entering into the Contract. The photo shall be deleted upon the User’s return.

  • ARTICLE 12/G – LESSOR’S OBLIGATIONS

The Lessor undertakes to provide equipment to the User in good working order, and shall provide the User with the equipment necessary for the User’s safety (namely a reflective vest for home rentals, and a helmet). The Lessor declines any liability that may arise in the event of non-use or improper use of equipment rented by the User or made available to the User. The Lessor declares that the rental equipment is appropriate for the intended use, and that there is no damage apparent, except for damage mentioned in the description of the rental equipment which is supplied to the User upon commencement of the rental period. It is the User’s responsibility to state any defect which is apparent and which does not appear in the description prior to the User’s departure. In the absence of a contradictory statement, the equipment shall be deemed to be free from any apparent damage, unless proven otherwise.

  • ARTICLE 12/H: USER’S OBLIGATIONS

The User shall be personally liable for any breach of the “Code de la Route” (Highway Code) and any bodily injury or property damage caused by the User during the use of the rental equipment in their possession (Articles 1383 and 1384 of the Civil Code). The User shall return equipment at the end of the rental period provided for in the Contract and in accordance with the conditions set out at Article 9 of these Terms and Conditions of Rental and Use.

  • ARTICLE 12/I: IMPLEMENTATION OF THE CONTRACT.

Supply and handover of the rental equipment shall take place at the Lessor’s operational bases, except where a User opts for home delivery of the equipment by the Lessor. These bases are located at Bandol, stade de Deferrari, and at St Antonin du Var 93, route de Carcès. The User shall accept the rental equipment in good working order and state of cleanliness, and with the battery fully charged, as expressly noted by the parties when establishing the condition of the rental equipment. The User must make any claim to the Lessor when establishing the said condition, and shall declare that the User has had full freedom to verify the quality of the rental equipment in accordance with the User’s requirements. In the event of failure of the rental equipment, or depletion of the battery during the rental period, the User may not claim any damages from the Lessor. Furthermore, neither recharging of the battery, nor repair following discharge of the battery, derailment or puncture, are covered by the Contract. Home delivery shall only take place in 24 hour increments, starting from a minimum rental amount of €90 in accordance with the following tariff: from 1 to 9 km from Bandol and Saint Antonin du Var rental points = €60; from 10 to 20 km from the Bandol and Saint Antonin du Var rental points = €100; from 21 to 30 km from Bandol and Saint Antonin du Var rental points = €120. The entry into force of the Contract and the transfer of risk and charges in respect of the rental equipment shall commence upon collection of the rental equipment by the User, and shall terminate upon the return of all the equipment rented in accordance with the provisions detailed below. In the event of early return, the User shall not be able to claim any reimbursement, unless such return is ordered by the Lessor due to the onset of weather conditions rendering cycling unsafe. In respect of home delivery, the transfer of risk shall take place upon delivery of the rental equipment and handover to the User. Transfer of risk to the User shall terminate upon return of rental equipment in full in accordance with the provisions detailed below. Use of the rental equipment is strictly limited to the User. Consequently, the loan or subletting of the rental equipment or its accessories is strictly prohibited. The User certifies being capable and medically fit to cycle. The User undertakes to respect the specificities of each of the bikes.  Cycling up and down pavements is strictly prohibited. In any event, the User must not ride on the beach or in the water. The User also undertakes not to cycle in the event of a puncture. The Lessor shall provide the User with information on routes. However, information provided relating to routes is only indicative. It may be inaccurate, or may be modified at any time. It is the User’s responsibility to verify the condition of the roads, the weather, the User’s cycling abilities and the practicability of the routes before setting out. As such, the person in charge of the rental base may, depending on the weather conditions, require the User to return to the Lessor’s premises, or prohibit access to certain tracks. If weather conditions are poor, the Lessor’s premises may be closed. In the event of premature return due to bad weather, and under the orders of the person responsible for the rental base, a deduction will be made in proportion to the rental period for the equipment rented. The Lessor cannot be held liable for any direct or indirect loss or damage linked to the use of the proposed routes, or the impossibility of using them. The User must stay on the tracks listed on the website in the “Parcours” (Routes) section, or on the routes integrated into the GPS, or on conventional traffic routes. The User undertakes not to cycle at night if the rental equipment does not have a lighting system at the rear and at the front. The User also undertakes not to use the rental equipment in a manner which exceeds the capacity of the equipment. In particular, the User must not carry a passenger other than a small child. The latter must be installed and secured on a seat designed specifically for this purpose. The User must not apply a weight of more than 20kg to any baggage rack supplied with the rental equipment. The User acknowledges that the Lessor has given the User the option of hiring a certified retro-reflective vest (for home delivered bicycles) and a helmet. It should be noted that, under the current applicable French legislation, the wearing of a helmet is not obligatory, but is strongly recommended, and that the wearing of a certified retro-reflective vest is obligatory for any cyclist cycling outside a built-up area, at night, or when visibility is insufficient. The User expressly declares having received all of the required safety information regarding the wearing of a helmet from the Lessor, thus excluding any liability of the Lessor in the event of damage. In addition, the User shall ensure that the battery charge is properly managed so that the User can return to the rental point on time. Under no circumstances shall the Lessor be held liable if the battery is depleted. When parking, the User must, without fail, secure the rental equipment to a support anchored to the ground using the anti-theft device provided by the Lessor. Both the front wheel and the rear wheel must be secured. The battery, the control screen, and where applicable, the GPS, must be removed from the rental equipment and remain in the possession of the User. The rental equipment is not insured against theft or breakage. In the event of theft of the rental equipment, the User shall immediately notify the Lessor, file a notice with the relevant authorities, and provide a photocopy of the notice. Theft of the rental equipment will be invoiced in accordance with the published tariff, in an amount greater than the security deposit, and will be due in full. In the event of a breakdown, the User undertakes not to work on the rental equipment without the express agreement of the Lessor, with the exception of and in the event of a puncture and use of the anti-puncture spray. For any other reason, the User must immediately contact the Lessor at BASE DE BANDOL +33(0)4 94 29 52 48, BASE DE SAINT ANTONIN DU VAR +33 04 80 28 44 94 OR +33 (0)679 60 94 94. Geolocation In order to preserve and protect the rental equipment, the Lessor may use electronic devices to track the movements of the rental equipment. This information may be used both during and after the end of the rental period. By accepting these general terms and conditions of rental, the User expressly acknowledges that they have given their explicit consent to the use of such electronic devices and to their geolocation. Assistance is geographically limited to roads accessible by motor vehicle, and it is the User’s responsibility to return to an accessible road, if applicable. Assistance is available 7 days a week from 10 am to 5 pm. Assistance is free of charge in the event of a problem which is intrinsic to the rental equipment. Problems such as derailment, battery depletion or puncture are not covered by free assistance. In cases where the Lessor is not obliged to provide assistance, the User shall bear the cost of assistance (€50 for Bandol, Sanary, Lorgues, St Antonin, €80 for La Cadière d’Azur, St Cyr sur Mer, le Castellet, Le Beausset and €120 outside of the aforementioned municipalities, and in an area within a perimeter of 50km from the rental locations). Return of the rental equipment shall be made on the date and time provided for in the Contract at the Lessor’s base, or in the case of home delivery by the Lessor, at any place provided for in the Contract. A statement as to the condition of the rental equipment will be drawn up and signed by the parties upon return. If the User retains the rental equipment beyond the period provided for in the Contract, without having rectified this situation, and/or does not return the rental equipment during the Lessor’s reception hours, the User shall lose the benefit of the guarantees provided in the Contract, and shall remain liable until handover of the rental equipment to the Lessor. The current rate for any delay exceeding fifteen minutes is ten euros per additional half hour, per item of rental equipment. Extensions to the Contract require an express request by the User to the Lessor, and must be made prior to the end of the rental period. The Lessor may refuse the extension without giving a reason.

  • ARTICLE 12/J: CANCELLATION OF RESERVATION

Confirmed reservations may be cancelled or amended free of charge up to 24 hours prior to commencement of the rental period. If this occurs less than 24 hours prior to commencement of the rental period, the rental amount shall be invoiced in full, in accordance with the rate applicable on the day of the rental. Any cancellation shall remove the right to reimbursement for the remaining rental period.

  • ARTICLE 12/K: USER’S LIABILITY

Throughout the rental period and until its return, the User shall be deemed to be the custodian of the rental equipment. As such, the User shall be held liable for any bodily injury or property damage suffered by the User or caused to a third party during use of the rental equipment, whether or not the User was the cause, or was using the rented items at the time. The User shall be liable for any deterioration in the rental equipment resulting from falls, acts of vandalism, natural factors, manipulation, transport violations, or the inappropriate use or misuse of the rental equipment. In the event of breakage, the User must return all the damaged equipment. Damage will be invoiced at the applicable rates appearing in the Contract. However, the User shall not be held liable for damage caused by hidden defects in the rental equipment, or wear which is not apparent but renders the equipment inappropriate for the use for which it is intended, insofar as proof of such faults or wear can be demonstrated by the User. Theft and loss of rental equipment is not covered. In these circumstances, rental equipment which has been lost or stolen will be invoiced on the basis of the replacement value appearing in the published tariff. In addition, the User shall contact the Lessor without delay, and shall file a notice with the relevant authorities and provide a photocopy of the notice. In the event of theft by the User, or of misuse, or any damage resulting from non-compliance with the rules of use, the applicable regulations, or the terms and conditions of this Contract, the Lessor shall be entitled to compensation in respect of all loss or damage.

  • ARTICLE 12/L: INSURANCE

By signing this Contract, the User expressly declares themselves to be the holder of personal civil liability insurance indemnifying the User in respect of the use of the rental equipment both by the User and the persons for whom the User is responsible. In addition, the User expressly declares to exonerate the Lessor from any liability arising from the use of the rental equipment, and in particular with regard to the bodily, physical and intangible consequences of accidents of any kind. Finally, by signing this Contract, the User declares that the User is fit to cycle and has no medical contraindications, and expressly exonerates the Lessor from any liability in this regard. ARTICLE 12/M: CONFIDENTIALITY In application of Law number 78-17 of 6 January 1978 relating to files, information technology, and freedoms, all information transmitted by the User to the Lessor may be the subject of authorised processing for subsequent operations, canvassing, or statistics. This information is intended exclusively for the Lessor. ARTICLE 12/N: APPLICABLE LAW AND JURISDICTION This Contract shall be subject to French law. The competent court is that of the place of the registered office of the company NATUREVASION, to which the parties attribute exclusive jurisdiction. .
